Terms of Use

The agreement for using Palettely

These terms cover what you can expect from Palettely and what we expect from you. Using the app means you accept them.

Effective date: September 7, 2026

This agreement is between you and Braxton Chandler (“we”, “us”), the developer of the Palettely iOS app (“the app”, “the service”). It also serves as the End User License Agreement for the app. If you do not agree, do not use the app.

1The service

Palettely generates a reference image from a text prompt you provide, converts it into a numbered paint-by-numbers template on your device, and lets you fill that template in. Image generation runs on a third-party model and requires a network connection; painting an existing template does not.

2Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, and able to form a binding contract. If you use the app on behalf of an organization, you represent that you may bind it to these terms.

3Your prompts and outputs

You are responsible for the prompts you enter. You agree not to submit prompts intended to produce:

• sexual content involving minors, or any content that sexualizes a real identifiable person without consent;
• content that infringes someone else’s intellectual property or publicity rights;
• harassing, hateful, or threatening depictions of real people or protected groups;
• material that is unlawful where you are, or that promotes serious harm.

As between you and us, we claim no ownership of your prompts or the images generated from them. Your right to use those images is also subject to the terms of the underlying model provider (fal.ai / the FLUX model). Generated images may resemble existing works or contain errors; you are responsible for checking an image before you rely on it or publish it.

4Acceptable use

Do not: reverse engineer, decompile, or attempt to extract source code or model weights from the app; probe or attack the backend; circumvent the free-tier limits or authentication; use automated means to submit prompts at scale; resell or redistribute access to the service; or use the app to build a competing product.

5Free tier and Palettely Pro

The app includes a limited number of free image generations per calendar month. The exact number may change over time.

Palettely Pro is an auto-renewing subscription sold through the Apple App Store, offered as a weekly or annual plan, sometimes with an introductory free trial. The following apply:

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period.
• If a free trial is offered, any unused portion is forfeited when you buy a subscription.
• Manage or cancel in Settings › Apple ID › Subscriptions on your device.
• Payments, renewals, and refund requests are handled by Apple under Apple’s Media Services terms. We do not process payments and generally cannot issue refunds directly.

6AI-generated content disclaimer

Images are produced by a generative model. They can be inaccurate, unexpected, or not match your intent, and the same prompt can produce different results. The service is provided for creative and recreational use.

7Changes to the app

We may add, change, or remove features, and may set or adjust limits, at any time. We may suspend or end the service, in whole or in part, with notice where practical.

8Disclaimers

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or USD 50.

10Indemnification

You agree to indemnify and hold us harmless from claims arising out of your prompts, your use of generated images, or your breach of these terms, to the extent permitted by law.

11Governing law

These terms are governed by the laws of the State of Kansas and the United States, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located there, unless a mandatory consumer-protection law in your place of residence provides otherwise. Nothing here removes a non-waivable right you have as a consumer.

12Apple-required terms

This agreement is between you and us, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide support or handle warranty claims for the app; any product-liability claim, IP-infringement claim, or consumer-protection failure is our responsibility, not Apple’s, to the extent required by law. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
